Re: ASADA issues show-cause notices to Essendon players

Surely the fact that they injected but can't provide evidence of what it was should be cause for sanction.

I agree. It should be the catalyst for a penalty, not Essendon's saving grace.
Our 1954 premiership players are our heroes, and it has to be said that Charlie was their hero.

Heard on SEN that WADA has named all 34 players in their statement to appeal.

Well if it all falls in a heap at least Essendon don't sleep easy until a resolution is reached.
But then again, I'm an Internet poster and Bevo is a premiership coach so draw your own conclusions.

The names of the 34 have all been leaked by CAS (although it wasnt hard to guess)

This is exactly the sort of point scoring bullshit I am concerned about.
They say Burt Lancaster has one, but I don't believe them.

The real problem here is the Bullsh*t sanctions that Demitriou handed out the year the drama first unfolded. In an effort to head things off/cover things up he handed out punishments. The problem here is that the culpability is the club and its administrators not the players. The options left for ASADA and WADA though are to attack the players - its pointless. On a scale of crimes - Illegal PED's must rank higher than tanking. Probably Match Fixing is the only thing worse....

I found it interesting that Little and Hird were lamenting that they were blindsided by WADA's announcement, believing that this issue was behind them.

They'll need to learn very quickly that they're not playing small town hick games anymore. The fact they thought they were entitled to any sort of warning provides some insight into how the AFL and ASADA managed the process to date.
                  TF is this?.........Obviously you're not a golfer.

The punishment of the club was required due to the damage the club caused to the game. The AFL acted appropriately within its powers.

As for the players, they are solely responsible for the position they find themselves in, and are first and foremost WADA's priority irrespective of what the AFL dished out in terms of punishments. They only have one job when it comes to what goes into their bodies, and that's completely understanding that what they put into it is legal and keeping the appropriate records to prove that it is.

This isn't a group charge it's individual, every player must have paperwork or proof of what they took and they already have said they don't have any evidence to prove what they took was legal, there fore they will be found guilty because you can't just say you have no records.
                      Source?

                      7. What is the standard of proof in the Court of Arbitration for Sport?

Most people are familiar with the standard of proof required by the criminal law and in civil law — even if just from the movies! The criminal standard is beyond reasonable doubt. The civil standard is the balance of probabilities. The standard CAS will apply is a different standard. It is one of “comfortable satisfaction”. That is the same standard applied by the AFL Tribunal and although its’ higher than the civil standard, it isn’t as high as the criminal standard.

The AFL didn't apply comfortable satisfaction. If they applied that than they had to find Watson guilty.

The James Hird interview on AFL360 was quite interesting - much more than the puff piece I was expecting. He made an assertion that a spreadsheet containing Thymomodulin was sent by Ian Robson to ASADA, who must have destroyed it - spare me. The AFL tribunal found that the substance in question was either TB4 or nothing. Thymomodulin was completely rejected as a viable alternative. Strike 1

Hird was also smacked down by Whateley, who had to correct Hird that the players were never cleared of taking TB4 - this question wasn't even considered by the AFL Tribunal. Strike 2

I'm much more concerned that we are comfortably satisfied that Essendon were supplied illegal PEDs but not unable to prove that they took them. AFLs handling of this issue was a disgrace.

Yes, I'm sure this 'smoking' spreadsheet that was sent to ASADA was the only copy in existence.
