    Hird won't rule out High Court appeal


    ESSENDON coach James Hird has left the door ajar for an appeal to the High Court over his failed bid to have the ASADA doping case against 35 present and former Bombers players ruled unlawful.

    Hird returned to Australia this week from New York, and admitted his unsuccessful Federal Court appeal against Justice John Middleton's finding that the joint ASADA-AFL investigation into Essendon's 2012 supplements program was lawful had been extremely costly.

    "It has cost me a lot of money," he told Channel Seven on Monday.

    "It's money we have to go out and find."

    Hird said his appeal to the Federal Court was about the players' rights to a fair hearing, which he claimed had not been afforded them.

    He said the players had been forced to give evidence without being given the confidentiality they were entitled to respect and without enjoying the same rights as the average Australian citizen.

    Hird said he "reserved the right" to take the matter to the High Court.

    The result of the AFL Anti-Doping Tribunal's inquiry into possible breaches of the League's anti-doping code is expected to be known within a month.

      Not sure if you've noticed James, but your players are not "average citizens". They are elite athletes who signed contracts with the AFL in order to become so. In doing so they submitted to the powers that have been found to be totally lawful by two courts.

      So go ahead. Appesl to the High Court so that you can be forced into bankruptcy when it blows up in your face yet again.

        That's if the High Court entertain letting the circus continue. If they were serious about not being caught up in it, they should just refuse to hear the appeal and it can be done with. Moments like this I wish Kirby J was still on the bench with some straight talking, perhaps the media should seek his insight.

          So he is admitting that the players took a banned substance, it's how they were caught that he is arguing about.

          When will this end. If you've done the crime you have to do the time.

          This bloke may have been a champion player but now he's a blight on the game.

            I doubt he'd be successful in an attempt to get to the High Court in the usual course - the case just doesn't merit it. The public interest and media level may have a bearing in some people's eyes, but I'm not convinced the court would be determining any substantive matter that will have an effect on 'people' generally.

            Presumably he'll make an application seeking special leave to appeal, which will then be flatly dismissed.

            Fingers crossed.

                      My footy watching, reading et al footy media experiences hijacked by garbage. If you mean anything good for anyone not serving a current suspension, then nothing yet.

                              For the issues I've raised which don't endear me to AD as an administrator, I don't think he's stupid. It would be a stupid person who would tip off someone directly. Watching any Hollywood movie on whistleblowing or tipping offing movies shows the use of inter mediatories to at least hide the trail. I've no idea what to make of it, as the guy making the allegation seems not to be entirely believable according to the AFL, ASADA and Federal Court...
