    Suggests that the former player is not someone who has an infraction notice but more for OH&S reasons.

      Good. If the the person was a tradie on a building site and had been injected with unknown substances for increased productivity, the streets would be blockaded by the union indefinitely and the press reporting far more critical. I hope he gets squillions in compensation as it's these kinds of cases of negligence and recklessness this area of the law is there for.

            I'd think yes to both points. I'd also think Essendon would be frantically trying to settle out of court under sworn secrecy as quickly as possible and for the minimum financial outlay.

              If Essendon's insurance won't cover them, then the AFL will have to put in A LOT of cash into Essendon to keep their doors open. Think even $250,000 time 30 players = $7,000,000 in payouts plus $10,000,000 in legals. Essendon don't have the cash. They could fold, or the AFL sends equalisaton money from poor clubs to pay their bills.

              Maybe Essendon player's should get the best class action lawyer in Australia...

                  It would seem that maybe it is someone who has left the club, but perhaps has issues effecting their career with their new employer. Perhaps missing the pre season games because of any back dating of penalties, or maybe uncertainty that their career at the new club may be artificially restricted due to the work practices of their previous employer ????????????

                  That hypothesis would narrow the field somewhat.

                  Of course it could be anyone of the group, for any number of reasons, I guess.

                    Their insurance may not be prepared to pay if it's proven they willfully circumvented standard OH&S protocols, such as ostracizing the club Doctor from the injection regime after he raised concerns, and taking players off site to hide aspects of the program. I would think there's a number of reasons for an insurer to consider the terms of their contract breached.

                      That's where I was headed. It wouldn't be the first time insurers would argue wilful indifference caused the damage and therefore not covered by acts of good faith. If the insurer pushes that button, then it's a free for all.

                            Yep. It's an interest possible scenario. Makes you wonder if the AFL would bail them out for $10,000,000+ and piss the entire country off, or let them fall into liquidation and start up another franchise with that money. If they bail them out with serous amounts of cash and then let us drown in the puddle next to them, I will lose the last teeny tiny modicum of faith in the AFL.
